Cincom Privacy Policy

(Effective May 25, 2018)

Cincom Systems, Inc., its subsidiaries and affiliates (collectively, “Cincom”, “we”, “us” or “our”) appreciates your interest in our products and services, and we are aware that you are concerned as to how the information you provide to us is used and shared with others. This Privacy Policy explains the policies and practices we follow to protect the personal information that we collect about you through the use of our website.

Our Privacy Policy consists of both this website’s Privacy Policy, and where applicable, the GDPR Privacy Notice and Cincom’s Privacy Shield Policy. We have established a comprehensive privacy program, including a global privacy office and a Chief Privacy Officer, designed to help us respect and protect your data privacy rights. What kind of information does Cincom collect?

We typically collect two kinds of information about you: (a) information you provide that personally identifies you and (b) information that does not personally identify you that we automatically collect when you visit our website or that you provide to us.

  1. Personal Information: As a general policy, we do not automatically collect your Personal Information when you visit our website. Personal Information means information relating to an identified or identifiable natural person. Specifically, Personal Information consists of your name, postal address, email address, date of birth, driver’s license number, financial account information, or other similar information. We may request, collect, or otherwise provide an opportunity to submit your Personal Information in connection with certain activities on our website, including but not limited to:
    • Participation in a survey or questionnaire
    • Registration screens and online forms
    • Delivery and address information from Cincom carriers and/or other third parties. This information is used to update our records and make future communication easier
    • The articles you select to read are captured and entered into a personal interest profile.
    • Personal information submitted by you as part of a job application.

    We do not knowingly collect sensitive information (information specifying medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or information specifying the sex life of the individual) when we request Personal Information. The Equal Opportunity Employment Commission requires that we report on gender, race, veteran status and disability status of applicants seeking jobs with Cincom Systems in the United States. Whether or not you provide this Personal Information is your choice and will not affect the hiring process. If you provide us with sensitive information, we will safeguard it and treat it as we do other Personal Information.

  2. Non-Personal Information: Non-personal information is any information that does not personally identify you. Non-personal information can include certain Personal Information that has been de-identified; that is, information that has been rendered anonymous. We obtain non-personal information about you from information that you provide us, either separately or together with your Personal Information. We also automatically collect certain non-personal information from you when you access our website. What does Cincom do with the Personal Information you provide?

We use the Personal Information you submit to us to:

Do you use preference-based advertising?

We do not currently share personal information that we collect for preference-based advertising purposes and we do not currently have any plans to do so through this site.

What are Cincom’s security measures?

Cincom takes steps we consider reasonable to protect Personal Information collected via this website from loss, misuse, unauthorized access, disclosure, alteration and destruction. Cincom has put into place appropriate physical, electronic and managerial procedures to safeguard and secure the Personal Information from loss, misuse, unauthorized access, disclosure, alteration and destruction. Keep in mind, however, that despite such reasonable safeguards, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and are not responsible for the theft, destruction, or inadvertent disclosure of your Personal Information. In the unfortunate event that your Personal Information is compromised, we may notify you by sending an e-mail (at our sole and absolute discretion except where required by law) to the last e-mail address you have provided to us in the most expedient time reasonable under the circumstances. However, delays in notification may occur while we take necessary measures to determine the scope of the breach and restore reasonable integrity to the system. Delays may also occur due to the legitimate needs of law enforcement should notification impede a criminal investigation. From time to time we evaluate new technology for protecting information, and when appropriate, we upgrade our information security systems.

Under what circumstances does Cincom share information?

Cincom does not sell, trade or rent your Personal Information to others. Unless we have your permission or are required by law, we will only share the Personal Information you provide online with other Cincom entities and/or business partners who are acting on our behalf to complete the activities described above. You will be given the opportunity to opt out: (i) if we decide to share your information with a third party (unless that third party is acting as an agent to perform tasks on behalf of us and under our instructions), or (ii) if it is to be used for a purpose that is incompatible with the purposes for which it was originally collected or subsequently authorized by you. We do not share sensitive information with anyone under any circumstances.

Our business partners and subcontractors receiving Personal Information are required to maintain the confidentiality of any data we provide or that they access in providing their services to us, and to apply security protection measures that are consistent with our promises under this Privacy Policy. We will ensure that any third party to whom Personal Information may be disclosed agrees in writing to provide an adequate level of privacy protection, and to only share Personal Information with those in their organizations with a need to know . These companies are authorized to use your Personal Information only for the purposes that we originally instructed, or as authorized by you.

Email Communications: We may share your email contact information with our partners to assist with marketing our products and services. You may unsubscribe from receiving future commercial email communications from us by clicking the "unsubscribe" link included at the bottom of any marketing emails we send, or by emailing us as provided in the “Contact Us” section below. However, we reserve the right to send you transactional emails such as customer service communications in connection with the products you have purchased. For security reasons, we do not recommend that you send PII, such as passwords, social security numbers, or bank account information, to us by email.

Transfer of Assets: We do not sell or lease personal information or provide a list of our customers to third parties, except as described above. However, as we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all (or substantially all) of our assets, the information we have about you will be transferred to and used by this acquiring entity. Use of Google Analytics and Advertising Tools

Cincom uses features provided by Google and Linkedin and integrated services that enable collection of data for advertising purposes. Third-parties, such as Google, set cookies to serve ads based on visitors' visits to Cincom websites. Any data collected will be used in accordance with Cincom and Google privacy policies.

This Privacy Shield Policy ("Policy") describes how Cincom Systems, Inc. and its subsidiary Cincom International Operations, Inc. Binding Arbitration

You may have the option to select binding arbitration for the resolution of your complaint under certain circumstances, provided you have taken the following steps: (1) raised your complaint directly with Cincom and provided us the opportunity to resolve the issue; (2) made use of the independent dispute resolution mechanism identified above; and (3) raised the issue through the relevant data protection authority and allowed the US Department of Commerce an opportunity to resolve the complaint at no cost to you. Cincom Anti-Spam Policy

What is spam?

Spam is unsolicited e-mail, often of a commercial nature, sent indiscriminately to multiple mailing lists, individuals or newsgroups. In short, spam is “junk e-mail.”

As defined by H.R. 3113 and reported by the Subcommittee on Telecommunications, Trade and Consumer Protection, unsolicited e-mail refers to any electronic message that:

  • advertises a product or service for profit,
  • is sent for other commercial purposes,
  • is sent to a recipient with whom the initiator does not have an existing business relationship or
  • invites the recipient to view content on an internet website that is operated for a commercial purpose.

Cincom recognizes an e-mail as “spam” if:

  • the recipient is unable to easily unsubscribe from the e-mail list,
  • the transmission contains invalid or forged headers, invalid or non-existent domain names or other means of deceptive addressing or
  • in the opinion of the recipient, the transmission and reception of the message appears to give a disproportionate benefit to the sender.

What is opt-in vs. opt-out e-mail?

Opt-in e-mail is a web marketing term for promotional e-mail that recipients have previously requested by signing up via a website or special ad banner. Typically, web users are invited to sign up for promotional information about one or more product or service categories. Those who sign up have thus “opted in.”

Opt-out e-mail is a web marketing term for promotional e-mail that recipients have not previously requested by signing up. However, for Cincom e-mail distributions, the contact’s e-mail address must have been provided to Cincom Systems, Inc. by that individual via a Cincom website, conference or trade show. Individuals who have willingly given Cincom their contact information via these methods are automatically added to e-mail distribution lists that benefit that individual. Although the individual is added to the e-mail distribution list on the concept of opt-out, the individual is ALWAYS given the opportunity to easily unsubscribe—without being hassled.

What is Cincom doing to become “anti-spam?

Cincom hopes that individuals find its e-mail communications informative and helpful. However, Cincom respects the recipient’s wishes for either receiving or not receiving e-mail communications from us. Therefore, Cincom has adopted the following as procedures for all of its e-mail distribution communications:

  1. Valid addressing – The e-mail communication will be sent to a single recipient with the intention of it being received by only one individual. The sender address will be a valid Cincom e-mail address that is monitored by a Cincom employee. Therefore the sender address can also be sent e-mail.
  2. Valid headers/subjects– The e-mail communication will always have a header or subject that is appropriate and true to the content provided in the communication. The header or subject will not be used inappropriately or give a disproportionate benefit to the sender.
  3. Valid contact information – Any contact information in the e-mail communication will be real and relevant to Cincom Systems, Inc.
  4. Valid subscribe/unsubscribe service – The e-mail communication will always have the “Cincom Subscription” information at the end. Cincom’s website will always provide information on how to subscribe or unsubscribe to any of its e-mail distribution lists (see this page). The process to subscribe and unsubscribe is simple, real and requires only a few seconds. Cincom also has a strict privacy policy posted on all of its websites, which addresses the fact that information collected by Cincom Systems, Inc. is not sold, but used internally for marketing and telemarketing campaigns.
  5. Relevant and beneficial information for the recipient – Cincom attempts to provide honest information about our company, solutions, products, services or other information that we feel will be in some way relevant and beneficial to the recipient.
  6. Mindfulness and compliance with company policies – Cincom’s e-mail distributions will be mindful and in compliance with its current Privacy Policy as well as its Anti-Spam Policy, which is in compliance with current international privacy-policy requirements.
